Regulus Investment and Financial Services Ghana Limited will only process your information where the Regulus has received the information directly from you as a data controller or by our clients where we are processors in accordance with their instructions and in line with the Regulus ’s obligations and your rights under the Data Protection Act, 2012- (Act 843) and other Jurisdictional Data Protection laws that are applicable. This Privacy Policy shall be amended or updated from time to time to reflect changes in our practices with respect to the processing of personal data, or changes in applicable data protection regulations.
The Personal Data we collect.
We currently collect and process personal information directly from you or from third parties we engage in our normal course of business. This includes the following:
  1. Personal details such as name, date of birth, family details, gender, ID details, Tax Identification Number (TIN), Social Security Number (SSN), contact information, online identifiers, passport pictures and any other similar information.
  2. Biometric information comprising of your fingerprints and facial recognition.
  3. Location and contact data such as postal address, residential address, digital address, email address and telephone numbers.
  4. Financial data such as bank account details, card payment details and other electronic or non-electronic payment details.
  5. Transaction data such as details about payments to and from you and other details of products and services you have acquired from us.
  6. Online identifiers such as internet protocol (IP) address, your login identity data, browser type and version, and information about how you use our website, products, and services.
  7. Information for regulatory compliance and monitoring purposes such as nationality, country of residence, source of funds, details of the origin of your wealth and other documents required for anti-money laundering, combatting the financing of terrorism, and proliferation of weapons for mass destruction which may be necessary to enable us comply with applicable regulatory reporting requirements.
  8. Voice and Video recordings including CCTV footage.
  9. The Regulus may also obtain your personal data from third parties depending on the products and services we provide to you. This will include trade or transaction counterparts, credit reference agencies, public registers (such as beneficial ownership registers), financial crime screening databases, fraud prevention agencies, and persons or entities instructed by you to provide us with your personal data.
What we use your Personal Data For Regulus Investment and Financial Services Ghana Limited will always process your personal data for a specific purpose and process only the personal data relevant to achieving that purpose. Depending on our relationship with you and the products and services that we provide to you, we may process your personal data for the following compatible purposes:

    • Upon sharing of your Personal Sensitive information with REGULUS , you hereby consent to collection and use of such information by REGULUS .
    • REGULUS specifically disclaims any liability with regard to any action resulting from your participation in any services, and you agree that you waive any claims against REGULUS relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against REGULUS resulting consequentially;
    • You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through the concerned relationship manager. We will make all reasonable efforts to make requested changes in our then active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or REGULUS has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, REGULUS may, at its sole discretion, discontinue the provision of services to you. There may be circumstances where REGULUS will not correct, delete or update your Personal Data, including (a) where the data is kept solely for evaluative purpose; and (b) the data is in documents related to a prosecution if all proceedings relating to the prosecution have not been completed;
    • REGULUS may require you to pay with a credit card, wire transfer, debit card or cheque for services, for which subscription amount(s) may be payable. REGULUS will collect your financial details such as bank account numbers, credit card number and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such information to third parties as necessary to complete such billing operation. Verification of information, however, is accomplished solely by you through the authentication process. Your credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. You are advised, however, that internet technology is not full proof safe, and You should exercise discretion on using the same.
    • As per the internet communication standards, when You or anyone else visits the Platform, REGULUS automatically receives the URL of the site from which anyone visits. REGULUS also receives the Internet Protocol (IP) address of each users’ computer / device (or the proxy server you used to access the World Wide Web), the computer operating system and type of web browser that you are using, email patterns, as well as the name of user’s ISP. This information is used to analyse overall trends to help REGULUS improve its service. The linkage between user’s IP address and personally identifiable information, is not shared with or disclosed to the third parties. Notwithstanding anything contrary, REGULUS may share and / or disclose some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business;
    • You may have limited access to the Platform without creating an account on the Platform. In order to have access to all the features and benefits on our Platform, a user must first create an account on our Platform; and
    • All information displayed on the Platforms is on “as-is” basis, making no representation or warranty on the accuracy or completeness of the information.
    • If you have inadvertently submitted any such information to REGULUS prior to reading the Privacy Policy set out herein, and you do not agree with the manner in which such information is collected, processed, stored, used or disclosed, then you may access, modify and delete such information by using options provided on the Platform or get it rectified through the concerned relationship manager.
    • Information other than the Personal Sensitive information that does not personally identify any user as an individual, is collected by REGULUS from its users (such as, patterns of utilization) and is exclusively owned by REGULUS . REGULUS may also use such information in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates;
    • REGULUS will communicate with the users / visitors (provided any contact information was shared by them) through email, phone and notices posted on the Platform or through other means available through the Platform or otherwise, including text and other forms of messaging.
    • At times, REGULUS conducts a user survey to collect information about users’ preferences. These surveys are optional and if users choose to respond, their responses may be kept anonymous.
    • REGULUS takes your right to privacy very seriously and other than as specifically stated in this Privacy Policy, will only disclose your Personal Sensitive information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when REGULUS , in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms & Conditions or in such other manner as may be required for any other purpose, at its sole discretion, ensuring reasonable confidentiality and security checks.

  • You acknowledge that some countries where We may transfer for processing or usage of Your Personal Sensitive information may not have data protection laws which are as stringent as the laws of Your own country.
  • You acknowledge that REGULUS may be obligated to by law to disclose or transfer your Personal Information with courts and / or government agencies in certain instances such as for verification of identity, or for prevention, detection, investigation, prosecution, and punishment for offences, or in compliance with laws. You hereby consent to disclosure or transfer of Your Personal Sensitive information in these instances.
  • Notwithstanding the above, we shall not be held responsible for the confidentiality, security or distribution of Your Personal Sensitive information by any third parties outside the purview of the Platform. Further, we shall not be responsible for any breach of security or for any actions of any third-parties or events that are beyond the reasonable control for us including but not limited to, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of internet service or telephone service of the user, etc.

  • REGULUS may also disclose or transfer your personal and other information, to a third party as part of reorganization or a sale of the assets of a REGULUS division or REGULUS itself. How long we keep your information
Where the personal information is no longer necessary for the purpose for which it was collected, we are enjoined by law to remove any details that is capable of being linked to you or in the alternative take steps to securely destroy the records.
There may be circumstances that would require the Controller to maintain records for a long period. For example, the Anti-Money Laundering Act requires us to keep books and records with respect to our customers and ensure that the records and underlying information are available on a timely basis to the Financial Intelligence Centre and other competent authorities. These records are to be retained for a period of five (5) years after our business relationship with you has ended.
Furthermore, the user’s personal information held in the form of a recorded communication, by telephone, electronically, in person or otherwise will be retained for six (6) years in accordance after the severance of the business relationship between the parties, pursuant to the relevant law. This period may be extended in cases where there is a legitimate interest at stake such as the settlement of a dispute between the parties. Again, the data may be retained longer than the number of years stipulated in this policy if by virtue of a legal regulatory or technical reasons; the said data cannot be deleted.
YOUR RIGHTS OVER THE USE OF PERSONAL INFORMATION
Once we have collected your personal information in pursuance of a particular purpose, you would be entitled to the following rights:
You are entitled to enquire from us whether your personal information is being processed and the type or specific information being processed. In addition, you may request to be furnished with a copy of your personal information, as well as other details being processed by us and we would be obliged to so furnish you within thirty (30) days of the request.
If for any reason the personal information that we have collected about you appears to be incomplete or inaccurate, you are entitled to have it rectified. Where the said information has been shared or disclosed to third parties, we shall ensure that the third parties are informed about the rectification.
